The Bride Rewards Program (“Bride Rewards Program“) is operated by Canada’s Bridal Show Ltd. (doing business as Canada’s Bridal Show), a corporation incorporated under the laws of Ontario, having an office at 136 Winges Rd. Unit 9, Woodbridge, ON  L4L 6C4, tel: +1 (905) 264-7000, fax: +1 (905) 264-7300, e-mail: info@canadasbridalshow.com (“Canada’s Bridal Show“, “us“, “our“, or “we“).  When you enroll in the Bride Rewards Program as a Member, we license you to collect Bride Rewards Points (“Points”) by making purchases with participating exhibitors, merchants and organizations (collectively, “Exhibitors”) and to redeem the Points in your Member Account for products and services purchased from Exhibitors or such other special offers and other rewards (“Rewards“) provided by Exhibitors or Canada’s Bridal Show, as Canada’s Bridal Show may choose to include in the Bride Rewards Program in its discretion from time to time.  The Bride Rewards Program may be administered in whole or in part by third party services providers (“Suppliers”).  Exhibitors and Suppliers are not, and shall not be deemed or presumed to be, representatives of Canada’s Bridal Show. Exhibitors and Suppliers have no authority to act on behalf of Canada’s Bridal Show or to assume or create any obligation or make any commitment on behalf of Canada’s Bridal Show.

Enrollment, membership and all related benefits of the Bride Rewards Program are offered at our discretion. By enrolling in the Bride Rewards Program or collecting Points, you agree that you have read and understand and agree to be bound by: (a) these Terms and Conditions; and (b) the terms of our Privacy Policy which can be found at http://www.briderewards.ca/index.php/privacy-policy/.  Our Privacy Policy is incorporated into these Terms and Conditions by reference.

We may update these Terms and Conditions or our Privacy Policy at any time as provided in Section 6 hereto and we recommend that you review these Terms and Conditions and our Privacy Policy from time to time by accessing http://www.briderewards.ca.

1. Enrollment in the Bride Rewards Program

(a)    To enroll in the Bride Rewards Program, you must be an individual who is a resident of Canada and have reached the age of majority in the province or territory in which you reside.  It is your responsibility to ensure, and you represent and warrant, that you are legally eligible to enter into these Terms and Conditions under any laws applicable to you in your jurisdiction of residence or otherwise.  If you participate in the Bride Rewards Program, you represent and warrant that you have the capacity to be bound by these Terms and Conditions.

(b)    Currently the Bride Rewards Program is only offered in the Province of Ontario and is only open to residents of Ontario and Ontario based Exhibitors.

(c)    To enroll in the Bride Rewards Program, you must enroll individually, only once, in your full legal name, and you must have both a valid mailing address in Canada and a valid e-mail address.  If we accept your application for enrollment, we will enroll you in the Bride Rewards Program as a collector of Points (a “Member”), establish an account (“Member Account”) in your name and issue you a Bride Rewards membership card (“Bride Rewards Card“).

(d)    To begin collecting Points and in order to redeem Points for Rewards you must register and validate your Bride Rewards Card at http://www.briderewards.ca/index.php/register.  You acknowledge and agree that Points collected on your Bride Rewards Card prior to registering the card may not be valid and may not be accepted for redemption or to collect Rewards.

(e)    You agree to provide true, accurate, current and complete information about yourself when registering with the Bride Rewards Program and in response to all other requirements that you provide any information to Canada’s Bridal Show or an Exhibitor, and you may not misrepresent your Member Account information.  You will promptly advise us of any change to your mailing or e-mail address or any change of your name.  Canada’s Bridal Show shall not be liable for misdirected communications not caused by us, whether by mail or e-mail or otherwise, or any consequences thereof.

2. Account Management

(a)    Points are personal and cannot be assigned, traded or exchanged without the consent of Canada’s Bridal Show except as required by applicable law.  Proper legal documentation will be required from all Members in order to effect a change of name.  In the event of the death of a Member, Canada’s Bridal Show will only transfer Points of that Member upon the presentation of, and in accordance with the terms of, a valid grant of probate or letters of administration by a duly authorized personal representative of the deceased Member.  A transfer fee equal to ten percent (10%) of the aggregate amount of the Points being transferred shall apply to all permitted transfers of Points on death of a Member, and such transfer fee Points shall be deducted from the Member Account of the deceased Member concurrently with the completion of the applicable transfer.

(b)    You are responsible for all applicable taxes (including, without limitation, value-added, sales, use, consumption, multi-staged, personal property, customs, excise, stamp, transfer, or similar taxes, duties, or charges) payable as a result of your participation in the Bride Rewards Program, including in connection with collecting and redeeming Points and obtaining Rewards.  In most cases, such taxes will be included in the Points value of the Reward being redeemed, and will not require a separate payment by you. 

(c)    The Bride Rewards Program entitles you to collect Points only from Exhibitors in Ontario.

(d)    You must identify yourself as a Member and present your Bride Rewards Card to be swiped when dealing with Exhibitors. Canada’s Bridal Show will issue Points to your Member Account only when you earn them from dealing with authorized Exhibitors in good standing with us, and only after your Bride Rewards Card has been validly processed at the point of sale with the Exhibitor. We are not responsible if an Exhibitor or Supplier delays or fails to inform us or for any other delay in issuing Points to your Member Account. Some Exhibitor locations may not participate in the Bride Rewards Program. A list of Exhibitors may be found at www.BrideRewards.ca.

(e)    We may refuse to issue or credit Points to your Member Account, or if already recorded, we may cancel them, if we cannot confirm that they were properly issued or obtained. Neither we nor any Exhibitor is responsible for any offer of Points which is no longer in effect. Any dispute must be settled between you and the Exhibitor.

(f)     If you believe that the number of Points in your Account is in error, you must tell us within 30 days of the date of the transaction for which the Points should have been issued or else the number of Points in your Member Account will be deemed to be correct, except for excess Points improperly recorded in it.  We may require you to submit documentation to support your claim.

(g)    A personal password (“Password”) will be required in order to access your Member Account and to redeem Points on www.briderewards.ca. You are responsible for maintaining the secrecy of your Password, for all activities that occur using your Password and for notifying us of any unauthorized use of your Password. Anyone who knows your Member Account number and Password will have full access to your Member Account, and may change the address associated with your Account and redeem Points recorded in your Member Account. Notify us immediately if your Bride Rewards Card is lost or stolen. We are not responsible or liable in any way for any loss arising from your failure to comply with these provisions.

(h)    In the event that you wish to discontinue your enrollment in the Bride Rewards Program, you must notify Canada’s Bridal Show in writing and return your Bride Rewards Card to us forthwith at our main office location, which is currently 136 Winges Rd. Unit 9, Woodbridge, ON  L4L 6C4. 

3. Earning Points

(a)    You may use your loyalty card to collect Points on each purchase from a qualifying Exhibitor.  Exhibitors award Points to you on the basis of the dollar amount of the sale, excluding taxes and gratuities.

(b)    Points are awarded at a rate of one (1) point for each $1 spent at a participating Exhibitor.

(c)    Points round up at each $0.50 spent. For example, at a participating Exhibitor, you will receive 10 points if they spend $10.40, and 11 points if you spend $10.50.

(d)    In order to earn Points, you must spend a minimum of $1.00 with a Exhibitor.  In addition, a maximum of $10,000 per transaction is eligible for Points.

(e)    Canada’s Bridal Show will credit to you, in Points, an additional one percent (1%) of the Points earned by you for each qualifying purchase of goods and services from an Exhibitor.

(f)     In the event of a return or refund transaction or a chargeback your Points accumulated will be debited by the corresponding amount.

4. Redemption of Points

(a)    Points may be used for Rewards that we or Exhibitors make available from time to time.  Points may be redeemed directly with the applicable Exhibitor for the purchase of participating goods and services, either at a Canada’s Bridal Show event or at the Exhibitor’s own premises.

(b)    The number of Points recorded in your Member Account and the number of Points required to obtain any particular Reward are subject to verification by Canada’s Bridal Show. Unless otherwise agreed by the applicable Exhibitor and subject to applicable law, once Points have been redeemed no exchanges, returns or refunds whatsoever are permitted.

(c)    In order to redeem any Points, you must redeem a minimum of 2,500 Points.  In addition, you are only able to redeem a maximum of 100,000 points per redemption transaction.

(d)    All Rewards are offered subject to availability and restrictions imposed by Exhibitors and/or Suppliers.  As Rewards are provided by Suppliers, we assume no responsibility for any loss, damage, defect, injury, death or expense relating to any act or omission of a Exhibitor, or any Reward, or for your Rewards not turning out as you expected for whatever reason not related to the consequence of Canada’s Bridal Show’s own act or the acts of its representatives.

(e)    All references to money in these Terms and Conditions are in Canadian dollars, unless otherwise indicated.

(f)     You are responsible for all taxes (including, without limitation, value-added, sales, use, consumption, multi-staged, personal property, customs, excise, stamp, transfer, or similar taxes, duties, or charges) applicable to any amounts payable to us. We will determine the applicable taxes on the basis of the province in which you reside, as shown in our records at time of payment.

5. Limitation of Liability

Neither we, our affiliates nor any of our or their respective officers or directors have any responsibility or liability for any expense, loss, cost, injury, damage, delay, event or exhibition cancellation, accident or any other matter or thing whatsoever (collectively, “Costs“), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to:

(i)     the Bride Rewards Program or your participation in the Bride Rewards Program;

(ii)    any failure, delay or decision by us in administering the Bride Rewards Program or amending these Terms and Conditions, our Privacy Policy, or the basis on which you can redeem Points;

(iii)   unauthorized use of your Bride Rewards Card or Password;

(iv)   any offer, representation, statement or claim about the Bride Rewards Program, any Exhibitor or Supplier or their products or services, made by a Exhibitor, Supplier or any other person; or

(v)    the purchase, redemption for or use of any goods or services of Exhibitors or Suppliers, and any other services or benefits not provided directly by us, including any merchandise, discounts, special offers or other Rewards.

This applies even if we or our representatives are advised of the possibility of such Costs.  You must deal directly with the applicable Exhibitor or Supplier in the event of any dispute relating to the purchase, redemption for or use of any goods or services of Exhibitors or Suppliers.

Without limiting the foregoing, any liability we may have to you or anyone else who obtains the benefit of any Points you redeem, under any circumstances, for any negligence, breach of contract or otherwise, is limited to crediting your Account with the number of Points you redeemed in connection with those circumstances, if any.  Points have no monetary value whatsoever and cannot under any circumstances form the basis of a monetary claim against Canada’s Bridal Show.

6. Termination, Amendments and Breach

(a)    We may amend any or all of these Terms and Conditions upon 30 days notice. You will be deemed to have accepted the changes if after the effective date of the notice, you use your Bride Rewards Card, redeem any Points or access your Membership Account in any way.

(b)    Bride Rewards Program details may be changed at any time. For example, at anytime, we may add, delete or change Exhibitors, Suppliers, participating event and exhibition providers, time limits for collection, redemption or use of Points, or Rewards; redemption conditions or procedures; or the number of Points required for particular Rewards. On behalf of Canada’s Bridal Show and the Exhibitors, we reserve the right to discontinue any particular Reward or to substitute any Reward for a similar Reward. (c)    If you become bankrupt, commit fraud, make any misrepresentation to us, violate these Terms and Conditions or any other agreements with us or our policies, we may, without affecting our other rights, disclose such information requested by proper authorities, terminate your enrollment and/or cancel your Points and Rewards.  

(d)    We may also terminate your enrollment upon 90 days notice for any reason, in which case you will have ten (10) days to use any outstanding Points. If your Member Account is inactive for a period of sixty (60) days, meaning that you have not earned Points with Exhibitors, redeemed Points for Rewards, or logged into your Member Account during such period, your Member Account will be terminated and any Points in your Member Account will automatically be voided  without compensation. Upon any termination of your enrollment for any reason, you agree to return your Bride Rewards Card to us forthwith at our main office location, which is currently 136 Winges Rd. Unit 9, Woodbridge, ON  L4L 6C4.  Canada’s Bridal Show reserves the right, in its sole discretion, to reinstate Member Accounts and Point balances upon written request.

7. General

(a)    These Terms and Conditions constitute the entire agreement between you and us regarding your participation in the Bride Rewards Program, your entitlement to collect and redeem Points and your entitlement to any other benefits of the Bride Rewards Program, and supersede all previous versions.

(b)    Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise and for greater certainty, Canada’s Bridal Show makes no representation, warranty, condition or guarantee as to the merchantability, fitness for a particular purpose or any other representation, warranty or guarantee regarding the subject matter of this Agreement, whether express or implied in law or fact, or in writing.

(c)    These Terms and Conditions will be governed by and interpreted in accordance with the laws of the Province of Ontario which shall govern any dispute arising out of or related to this Agreement and the parties agree to attorn to the jurisdiction of the courts of the Province of Ontario.

(d)    We will not be taken to have waived any of our rights even if we redeem Points when not required. All materials and any notices from us will be sent to your address as in our records. You must notify us promptly if your address changes.

(e)    If any provision of these Terms and Conditions is invalid or unenforceable, such provision shall not affect the validity and enforceability of the remaining Terms and Conditions.

(f)     When you deal with us over the Internet, you consent to the formation of contractual relations through electronic communications. Use of our website is subject to the terms of use displayed thereon from time to time.
